Terms of Use

The mobile application “MyViral” (hereinafter referred to as the “Application”) is owned and operated by Borislav Nachev (hereinafter referred to as the “Data Controller”).

By accessing, installing, and/or registering within the Application, the User declares that they have read, understood, and agree to comply with these Terms and Conditions.

If the User does not agree with these Terms and Conditions, they must discontinue using the Application.

The “MyViral” Application is a platform for publishing, sharing, and rating user-generated content, including photos and videos, as well as for participating in voting activities and interacting with other Users.

To use the full functionality of the Application, registration is required.

The User undertakes to provide accurate, current, and complete information.

The User is responsible for maintaining the confidentiality of their account and for all activities conducted through it.

The Data Controller reserves the right to refuse registration or terminate a User account in case of a violation of these Terms and Conditions.

The User is responsible for the security of their password and account.

Each User is allowed to create only one account. The creation of fake accounts is prohibited.

Users have the right to use the Application’s functionalities in accordance with these Terms and Conditions.

Users undertake not to:

• publish unlawful, offensive, discriminatory, or misleading content;
• infringe the rights of third parties;
• publish personal data of other individuals without their consent;
• attempt unauthorized access to or abuse of the system;
• use automated systems (bots), unless explicitly permitted.

Users bear full responsibility for any content they publish within the Application.

By publishing content, the User grants the Data Controller a non-exclusive, royalty-free right to store, display, and distribute such content within the Application.

The Data Controller shall not be held responsible for any content published by Users.

Original content only: Users are permitted to upload only photographs that have been taken by themselves and in which they hold full copyright ownership.

Prohibited content: It is strictly forbidden to upload photographs containing:

• erotic, pornographic, or sexually explicit material;
• violence, hate speech, discrimination, or offensive content directed at others;
• personal data of third parties without consent (e.g., identifiable persons, vehicle license plates);
• advertising materials, logos, or watermarks used for commercial purposes.

Voting must reflect the genuine opinion of Users.

Bot prohibition: The use of automated systems (bots), scripts, or paid networks to manipulate voting results is strictly prohibited.

In case of detected unusual activity, the Data Controller reserves the right to reset votes for a given photo or remove it entirely from the Application.

Certain content, including username, profile information, and uploaded photos, may be publicly visible to other Users.

Users are responsible for any information they voluntarily choose to publish.

The Application may allow Users to share contact information (email, phone number, website) at their discretion.

The Data Controller does not moderate and assumes no responsibility for the content of messages or communications exchanged between Users outside the Application.

The use of other Users’ contact details for sending unsolicited messages (spam) or harassment will result in immediate account suspension.

In case of violation of these rules, the Data Controller reserves the right, at its sole discretion and without prior notice, to:

• delete the relevant photo;
• invalidate votes;
• block or permanently delete the User account.

The Data Controller does not guarantee uninterrupted or error-free operation of the Application.

The Data Controller shall not be held liable for:

• content published by Users;
• interactions between Users;
• any direct or indirect damages arising from the use of the Application.

The Application is provided on an “as is” basis. The Data Controller shall not be held liable for technical failures, data loss, or any disputes related to copyright between Users. Responsibility for uploaded photographs lies entirely with the User who has shared them.

The following actions are strictly prohibited:

• using the Application for unlawful purposes;
• infringing the rights of third parties;
• distributing malicious software;
• manipulating voting results;
• creating fake accounts.

The Data Controller has the right to restrict or terminate User access in case of:

• violation of these Terms and Conditions;
• unlawful or harmful behaviour;
• misuse of the system.

The User may delete their account at any time.

MyViral is committed to protecting users and maintaining a safe community. We have zero tolerance for child sexual abuse and exploitation (CSAE).

Users may not upload, share, or distribute any content involving child sexual abuse, exploitation, grooming, or any activity that harms minors. Any account involved in such activities may be removed or permanently banned.

Users can report unsafe content or accounts through available reporting tools or by contacting us. We review reports and take appropriate action, including removing content and cooperating with authorities when required by law.

The processing of personal data is carried out in accordance with the Application’s Privacy Policy, which forms an integral part of these Terms and Conditions.

All rights to the Application, including its design, software, and content created by the Data Controller, are owned by the Data Controller or used under lawful authorization.

Users are not permitted to copy, modify, or distribute any elements of the Application without explicit permission

The Data Controller reserves the right to amend these Terms and Conditions.

Users will be notified of any material changes via the Application or through other appropriate means.

Continued use of the Application after such changes shall constitute acceptance of the revised Terms.

These Terms and Conditions shall be governed by the laws of the Republic of Bulgaria.

All disputes shall be resolved amicably, and where this is not possible, by the competent Bulgarian courts.
